Kerala High Court Orders Strict Action Against Aftermarket Bike Modifications

Any modification in your bike that is unsafe and unhealthy for road users will be punishable from now in Kerala.

The Kerala high Court ordered police and motor vehicles department to take strict actions against specific bike modifications that reduce the safety and negatively impact the health of others. The list of modifications acknowledged by the court includes various procedures like installation of loud silencers in bikes.

 

It was Justice V Chitambaresh who issued the directing orders after hearing a petition filed by Mr. Francis MC. Francis got his Royal Enfield bike straight handles and replaced its stock silencer with a loud one. His basic objective was to sue a check report issued against him for violation of Motor Vehicles Act, 1988 by motor vehicles department.

As per the judgment, loud and thunderous noises that emanates from high-speed two wheelers have a serious effect on ears. These are extremely unhealthy and unsafe for the ailing and old aged people who walk on roads. The level of sound should be under the decibel limits mentioned by the Environment Protection Rules and Regulations, 1986 especially designed to reduce noise pollution. Although, the motor vehicles department didn’t test the motorcycle to determine the decibel level of silencer fitted in Mr. Francis’s vehicle.

The court included several others after purchase modifications in the judgment such as small handlebars. These may look sleek and stylish, but they are known for disturbing the equilibrium of bikes and can easily lead to any mishap. Similarly, a motorcycle without mudguard will splash dirt and mud over the rider as well as the passersby.

Another mention worthy modification is the theatre seats which are inclined more than the one allowed by manufacturer, it leads to removal of handle for pillion rider and can easily throw his or her in air in a moment. The court withdrew permissions for withdrawal of saree guard and pillion rider’s handle. And last but not the least; it is now banned to replace the glare-free headlights with over-bright glittering headlights.
