India’s Mahindra Wins IPR Case Against Fiat Chrysler In the US

In August 2018, Fiat Chrysler Automobiles NV filed a U.S trade complaint against the Indian auto major Mahindra & Mahindra to prevent it from importing and retailing the Roxor in the United States. The Italian carmaker claimed that Mahindra Roxor infringes copyright of Willys Jeep’s signature trade dress – “boxy body shape with flat-appearing vertical sides and rear body ending at about the same height as the hood.”

In response to the filed case, the US International Trade Comission (USITC) denied FCA’s motion for preliminary injection and prevented the carmaker from brining a complaint against Mahindra Automotive North America (MANA) in the court. The court has also barred the Italian carmaker from pursing the further investigation. If the US Trade Commission acknowledges the results of the Commission Investigative Staff, Mahindra & Mahindra will be allowed to import the Roxor off-roader from India and sell in the U.S. market.

While the official figures are still under the wraps, Mahindra is likely to retail over 4,000 units of the Roxor off-road vehicle in the US so far. Just so you know, Mahindra & Mahindra introduced the Roxor in the US market in March, 2018. The off-road vehicle is priced at $15000 and offered with a 2.5L, 4-cylinder diesel engine. The Mahindra Roxor is based on the Thar SUV, but devoid of the hard top roof and the windscreen.
